Frequently Asked Questions

Find answers to our clients most commonly asked questions.

Can I represent myself instead of getting a lawyer?

It is not recommended for you to pursue your case on your own. If you try to handle a case by yourself, you’ll be going against experts from insurance companies who want to compensate you as little as possible. They will try to settle for far less than the actual value of your case. Not to mention, the legal and insurance process is very difficult to navigate on your own. You will be much better off in the hands of an experienced Screven County attorney.

How long will it take to reach a settlement?

This can depend on a variety of things; the severity of your injuries, recovery time, and the type of insurance you have. If your injuries are minor and you have good insurance coverage, a case can settle within three to six months. However, if you have a serious injury and/or there are major disputes with the insurance company who is at fault, your case can last much longer. Additionally, lengthy medical treatment can significantly impact the length of your case.

What types of benefits am I entitled to in a personal injury case?

You are entitled to any out-of-pocket expenses (such as vehicle repairs or the market value of your vehicle). You are also entitled to rental expenses in the event of a total loss of your vehicle. If you sustained any injuries from your accident, you’ll have your medical bills paid for, in addition to any loss of earnings for past, present, and future work. Lastly, you are entitled to damages in the form of pain and suffering, whether emotional or physical.

Should I go to a doctor?

If you were injured in any type of accident, it’s important to seek medical attention immediately. In some cases, the severity of your injuries might not be immediately apparent however, it is advised to seek the attention of a medical professional none-the-less. We have doctors that are familiar with the legal system that we can refer you to however if you need a doctor immediately use your general practitioner or emergency facilities.

Who pays for the doctor bills?

In personal injury cases many doctors will not require money during the course of treatment, and wait until a settlement is reached to get paid- this is called taking a case on a ‘lien’ basis. If liability or fault is questionable sometimes it’s best to use your private medical insurance for your needs but that will depend on your specific case. Once fault is determined, the at-fault party and their insurance company will be responsible for your medical expenses. Your doctor and your attorney will consult regularly to make sure that the expenses incurred are within reason and that they will be in fact covered by the at-fault party’s insurance.

When should my personal injury claim be filed?

By rule of thumb it’s best to file your personal injury claim as soon as possible. In Massachusetts, there’s a three-year statute of limitation date in most personal injury cases. However, depending on your type of case, it may call for a shorter or longer period of time to be filed. Each case is different and must be handled a different way. It’s best to consult with an attorney if you’re thinking of filing to answer any questions you may have.

How long before I will be compensated for my injuries?

Generally a lawsuit will not be initiated until medical treatment is completed. While this may take a while if your injuries are severe it’s important for your attorney to know the full range of your injuries in order to make sure you get the compensation you deserve and be able to represent you to the fullest extent. However, fault (or liability) should be established as soon as possible after an accident. We can’t stress enough how every person is different and therefore every case is different, and we hope to answer any and all questions you may have and support you during your healing process.
